Examples of the Notable Reported Cases:

Satya Dev Sharma (UKAITUR/2019/1A146462014): a complex case on the applicability of the Regulations under the Immigration (European Economic Area) Regulations 2006 as amended, not the Immigration (European Economic Area) Regulations 2016; the appeal confined to two matters namely whether or not regulation 9 (2) of the Immigration (European Economic Area) EEA Regulations applies; and whether or not the “Centre of Life Test” in Regulations 9 (3) was satisfied. Applying 2006 Regulations the UT Judge found that the Appellant met both the applicable conditions. Shireen was the Solicitor on the case and the appeal was allowed giving substantial relief to the Appellant.

Mr GS, Mrs HK and Miss AK (HU/00490/2019, HU/00507/2019 & HU/00498/2019): The issue in these appeals was whether a stateless person needs to show they have taken reasonable steps to acquire a nationality to which they have an entitlement dependent upon making an application. The Judge below held assessing proportionality and balancing exercise that the third Appellant (stateless person) should not be removed for the stated reasons; the SSHD appealed the UT which endorsed the FtT Judge’s decision.

RSB/V/SSHD (2020, UKAITUR (PA80592019): This was an asylum matter in which the Upper Tribunal found that Sikhs and Hindus in Afghanistan are not refugees per se discrimination is, by its very nature, often very closely allied to persecution; therefore, the Judges below should apply the background material on the basis of which the decision of the First-tier Tribunal was set aside allowing the Appellant’s appeal.
